Pixnary ("Pixnary") is a product of Youstart Education OPC Private Limited ("Youstart"). Youstart provides this Privacy Policy to help you make an informed decision about whether to use or continue using the Pixnary Site and/or Pixnary Software. If you do not agree to our practices, please do not use the Pixnary Site or Pixnary software.
This Privacy Policy is incorporated into and is subject to the Pixnary Terms of Service. Your use of the Pixnary Site and Pixnary Software remains subject to the terms of this Privacy Policy and our Terms of Service.
Please note that any content sharing on "Facebook" or "Google+" at the discretion of users of the Pixnary Service becomes published content and is not considered personally identifiable information subject to this Privacy Policy.
What Does This Privacy Policy Cover?
This Privacy Policy is part of Youstart's Terms of Service and covers the treatment of user information, including personally identifying information, obtained by Youstart, including information obtained when you access the Pixnary Site or use the Pixnary software provided by Youstart.
This Privacy Policy does not apply to the practices of companies that Youstart does not own or control, or to individuals whom Youstart does not employ or manage, including any of the third parties to which Youstart may disclose user information as set forth in this Privacy Policy.
The Information Youstart Collects
Youstart may obtain the following types of information from or concerning you or your mobile phone device, which may include information that can be used to identify you as specified below ("Personally Identifying Information"):
User Provided Information: You may provide certain Personally Identifiable Information, such as your mobile phone number, your email address, push notification name (if applicable), billing information (if applicable) and mobile device information to Youstart when choosing to participate in various uses of the Pixnary Service, such as registering as a user or requesting Premium Service. Youstart may use this information to inform you about new offers, products or services and to execute certain service processes such as push-notifications.
Cookies Information: When you visit the Pixnary Site, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. Pixnary uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, the Pixnary Site may not function properly if the ability to accept cookies is disabled.
Log File Information: When you use the Pixnary Site, the server automatically records certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, one or more cookies that may uniquely identify your browser or your phone number.
The Information PIxnary Does Not Collect
Pixnary does not collect names, emails, addresses or other contact information from its users" mobile address book or contact lists.
The Way Pixnary Uses Information
If you submit Personally Identifiable Information to us through the Pixnary Site or Pixnary app, then we use your personal information to operate, maintain, and provide to you the features and functionality of the Pixnary Site and Pixnary app. Any billing information that may be collected from you will be deleted thirty (30) days after the termination of your account with Pixnary. Any Personally Identifiable Information that you voluntarily disclose on the Pixnary Service becomes publicly available and may be collected and used by other users of the Pixnary Service (unless such user is blocked by you). We do not use your mobile phone number or other Personally Identifiable Information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your mobile phone number (or email address, if provided) without further consent for non-marketing or administrative purposes (such as notifying you of major Pixnary Site or Pixnary Service changes or for customer service purposes). We may use both your Personally Identifiable Information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Pixnary Site and Pixnary Service and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends. Hopefully we improve the Pixnary Site and Service and don't make it suck worse. We may use cookies and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you use the Pixnary Service or Pixnary Site; (b) provide custom, personalized content and information; (c) monitor individual and aggregate metrics such as total number of visitors, pages viewed, etc.; and (d) track your entries, submissions, views and such.
When Pixnary Discloses Information
We do not sell or share your Personally Identifiable Information (such as mobile phone number) with other third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may share your Personally Identifiable Information with third party service providers to the extent that it is reasonably necessary to perform, improve or maintain the Pixnary Service. We may share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, asset views, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Pixnary Site. Youstart also reserves the right to disclose Personally Identifiable Information and/or non-personally-identifiable information that Youstart believes, in good faith, is appropriate or necessary to enforce our Terms of Service, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Pixnary Site or our servers, and to protect the rights, property, or personal safety of Pixnary, our users or others.
Your Choices
You may, of course, decline to submit Personally Identifiable Information through the Pixnary Site or the Pixnary Service, in which case Pixnary may not be able to provide certain services to you. If you do not agree with our Privacy Policy or Terms of Service, please uninstall the Pixnary mobile application and discontinue use of the Pixnary website; your continued usage of the Pixnary Service will signify your assent to and acceptance of our Privacy Policy and Terms of Service. Third-party Advertisers, Links to Other Sites
Pixnary is currently ad-free and we hope to keep it that way forever. We have no intention to introduce advertisement into the product, but if we ever do, will update this section.
Our Commitment To Data Security
Pixnary uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Pixnary and you do so at your own risk. If Pixnary learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Pixnary may post a notice on the Pixnary Site or through the Pixnary Service if a security breach occurs.
Special Note to International Users
The Pixnary Site and Service are hosted in India and are intended for and directed to users in India. If you are a user accessing the Pixnary Site and Service from the European Union, US, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from Indian laws, please be advised that through your continued use of the Pixnary Site and Service, which are governed by Indian law, this Privacy Policy, and our Terms of Service, you are transferring your personal information to India and you expressly consent to that transfer and consent to be governed by Indian law for these purposes.
In the Event of Merger or Sale
In the event that Pixnary is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control.

This is an agreement between Youstart Education OPC Private Limited ("Youstart"), the owner and operator of www.pixnary.com (the "Pixnary Site"), the Pixnary software, including GRE Pixnary and CAT Pixnary (collectively called as "Service" or "Pixnary Service") and you, a user of the Service. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS OF SERVICE, AND YOUSTART'S PRIVACY POLICY, WHICH CAN BE FOUND AT http://www.pixnary.com/legal.html/#terms, AND WHICH ARE INCORPORATED HEREIN BY REFERENCE. If you choose to not agree with any of these terms, you may not use the Service.
These Terms of Service apply to all users of the Service. "Information", in the form of text or images, provided by our service may link to a person, gender, group, community, country, product, third-party-service or popular beliefs. The information provided is solely for educational purpose. Youstart has no control over, and assumes no responsibility of the resemblance of any information contained in our service with a real situation or person, nor do we promote any product, service, person, community or popular belief through this information. In addition, Youstart will not censor or edit the service content based on individual objections, unless legally obliged to do so. As the information provided is collected using open sources, reuse of the content is allowed while complying with the terms and conditions of this Terms of Service. The "Facebook" and "Google+" share and like option provided on Pixnary website shall be used as per the Term and condition of "Facebook" and "Google" respectively. Youstart has no control over, nor does it take responsibility of any objectionable comment, like or further sharing on your shared post. By using the Pixnary Service, you expressly acknowledge and agree that Youstart shall not be responsible for any effects, claims or other liability arising from or related to your use of or sharing of the information.
A. Subject to your compliance with these Terms of Service, Youstart hereby grants you permission to use the Service, provided that: (i) your use of the Service as permitted is solely for educational purpose, and you are not permitted to resell or charge others for use of or access to the Service, or in any other manner inconsistent with these Terms of Service; (ii) you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without Youstart's prior written authorization; (iii) you will not attempt to reverse engineer, alter or modify any part of the Service;(iv) as the information provided is collected using open sources, you can use the content separately, but you will not use the information in the same data flow in any other product as provided by the service and (v) you will otherwise comply with the terms and conditions of these Terms of Service and Privacy Policy.
The design of the Pixnary Service along with Pixnary created text, scripts, graphics, interactive features and the like, and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Youstart, subject to copyright and other intellectual property rights under relevant laws in India. The Service is provided to you AS IS for your information and personal use only. Youstart reserves all rights not expressly granted in and to the Service. You agree to not engage in the use, copying, or distribution of any of the Service for any commercial purposes.
YOU AGREE THAT YOUR USE OF THE PIXNARY SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, YOUSTART, ITS DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. YOUSTART MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SERVICE'S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE THROUGH THE ACTIONS OF ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONSIN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE IN THE FORM OF PIXNARY CONTENT. YOUSTART DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE PIXNARY SERVICE. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE. AND AGAIN, USE THIS JUST FOR FUN.
IN NO EVENT SHALL YOUSTART, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS OR DATABASE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY, (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE IN THE FORM OF PIXNARY CONTENT, AND/OR (VI) THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OF SERVICE OR PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
YOU SPECIFICALLY ACKNOWLEDGE THAT YOUSTART SHALL NOT BE LIABLE FOR ANY LOSS, FAILURE OR DAMAGE CAUSED IN ANY EXAM, INTERVIEW OR ANY SELECTION PROCEDURE DUE TO ANY ERROR, OMMISSION, MISTAKE OR INACCURACIES FOUND IN PIXNARY CONTENT.
The Pixnary Service is controlled and offered by Youstart Education OPC Private Limited from its facilities in India. Youstart makes no representations that the Pixnary Service is appropriate or available for use in other locations. Those who access or use the Pixnary Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.
You agree to defend, indemnify and hold harmless Pixnary, its parent corporation, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Pixnary Service; (ii) your violation of any term of these Terms of Service;or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms of Service and your use of the Pixnary Service. We don't support or encourage illegal consumption of alcohol or tobacco, so there.
You affirm that you are either more than 10 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are at least 10 years old as the Pixnary Service is not intended for children under 10. If you are under 10 years of age, you are not permitted to use the Pixnary Service. You further represent and warrant that you are not located in a country that is subject to Government of India embargo, or that has been designated by the Government of India as a" terrorist-supporting" country, and that you are not listed on any Government of India list of prohibited or restricted parties. Youstart is the developer of the Service, with an address at B-138, W.No.15, Agrasen Nagar, Churu, Rajasthan- 331001.
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Youstart without restriction.
You agree that: (i) the Pixnary Service shall be deemed solely based in Rajasthan; and (ii) that you agree to subject to the jurisdiction of Rajasthan in the event of any legal dispute. These Terms of Service shall be governed by the internal substantive laws of the State of Rajasthan, without respect to its conflict of laws principles. Any claim or dispute between you and Youstart that arises in whole or in part from the Pixnary Service shall be decided exclusively by a court of competent jurisdiction located in Rajasthan. These Terms of Service, together with the Privacy Policy at http://www.pixnary.com/legal.html/#privacy and any other legal notices published by Youstart, including, but not limited to an end user license agreement, shall constitute the entire agreement between you and Youstart concerning the Pixnary Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Youstart's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Youstart reserves the right to amend or modify these Terms of Service at any time, and it is your responsibility to review these Terms of Service for any changes. If you do not agree to the revised Terms, your only recourse is to discontinue the use of the Pixnary Service. Your continued use of the Pixnary Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND YOUSTART AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PIXNARY SERVICE MUST COMMENCE WITHIN ONE (1) MONTH AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
